This website is owned and operated by Authentic Wagyu, LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors Wagyu Beef that is both imported from Japan, and raised in the United States of America. By accessing or using the website of our service, you agree that you have read, understood, and agree to be bound by these Terms.
Eligibility
In order to use our website and/or receive our services, you must be (a) at least 18 years of age, or of the legal age of majority in your jurisdiction, (b) possess the legal authority, right and freedom to enter into these Terms as a binding agreement, and not have more than one Authentic Wagyu account. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Purchasing Terms
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time and to correct pricing errors that may inadvertently occur. Additional information about pricing, shipping, and sales tax is available on the payment page at the point of checkout.
Payment and Billing
Providing a credit card for purchases, or other forms of payment we accept means that you represent and warrant authorized use to complete the transaction and will be billed for the price shown at checkout upon purchase. If you pay with a credit card, Authentic Wagyu may seek pre-authorization of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover the payment of your purchase. If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or canceled. You are responsible for any issues that occur with the payment of your order. If you would like to add, remove, or change a credit card or other accepted payment method, you may do so at any time by editing your payment method on your account page.
You acknowledge that the amount billed may vary due to promotional offers, changes to our service or changes in applicable taxes or other charges, and you authorize us, or our third-party payment processor to charge your payment method for the corresponding amount.
Pricing and Availability
All prices are represented in USD. The prices shown by Authentic Wagyu are subject to change at any time for any user. These prices may vary due to availability, promotional pricing, or any other changes Authentic Wagyu sees fit. Promotional pricing, unless made directly to you, will not apply to your offer or these terms.
All products offered by Authentic Wagyu are subject to availability and we reserve the right to impose order quantity limits, add, remove, or substitute items from the website without prior notice. Our goal is to deliver you the finest quality Wagyu beef products. Due to the nature of delivering perishable goods and market conditions beyond our control, we may be required to make a substitution on this rare occasion. If you are still dissatisfied with your substitution, please contact info@authenticwagyu.com.
Taxes
Authentic Wagyu will collect applicable sales tax on products shipped to states for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the amount of taxes shown at checkout may be adjusted. These changes will be made visible prior to purchase. Several factors may cause this, including but not limited to variances between processor programs and changes in tax rates.
Return Policy and Refunds
For any undamaged product, please return it with its included accessories (if applicable) and packaging along with the original receipt (or gift receipt) within 7 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note that products can be returned only in the country in which they were originally purchased. If such an issue arises, please contact info@authenticwagyu.com. regarding any purchase issues or concerns.
If for any reason you are not satisfied with your order, please contact us at info@authenticwagyu.com. We may either issue a new product at our expense and have you return the product to us if it is not damaged or opened, or we may issue a full or partial refund or credit, depending on the circumstances. Due to the nature of perishable products, we do not do exchanges, however, we may request to have the product shipped back to us so we may evaluate the condition of the product and how it was shipped, and to take corrective action in our shipping methods as much as reasonably possible. It is important to note that due to the nature raising and processing our animals, there is going to be a variation in the size of the animal and the amount of meat that comes from them. We do our best to achieve a uniform product and as close to the advertised weight as possible. However, we cannot guarantee that a product is exactly the weight as advertised, or that the general shape and nature of the meat will be represented by the photos of the product online. In the event that you are dissatisfied with the product based on weight, cut, shape, or any other physical aspect of the product(s), we ask that you send photos and other documentation to info@authenticwagyu.com before we issue any kind of credit or refund.
Any persons who do not accept and abide by the terms and conditions outlined in this section will not be eligible for any refund or credit.
Shipping and Handling
Authentic Wagyu includes free shipping on all products purchased on our website. We reserve the right to increase our product costs based on your final shipping destination outside of the lower 48 states in the United States. Any changes that are made regarding shipping and handling will be made aware to you prior to the completion of purchase. Upon receiving your purchased product, you accept and understand that there is to be no export or resell, or redirecting of an Authentic Wagyu product. All Products purchased from Authentic Wagyu are made pursuant to a shipment contract. This means that the title to and the risk of loss of such product(s) passes to you upon our delivery of the product(s) to a third-party courier.
Product Deliveries
You are responsible for inspecting all products received from Authentic Wagyu. This includes inspecting for damage, and determining if the product is received as the product says it will arrive; either frozen or partially thawed. We make every effort to ensure that your product(s) gets to you frozen or cold. You are responsible for checking the contents of the package to ensure that the proper cooling has been included. We recommend using a meat thermometer to verify that your product(s) temperature is at 40°F or below. In the unlikely event of your product(s) being above 40°F, or if you have other reason to believe that the product you received is not safe for consumption, please notify info@authenticwagyu.com and place in the freezer if there is no odor or damage to the product, otherwise discard and document. We will process your request and will issue either a replacement product at our expense, credit your account, or issue a refund. We recommend immediately placing the product(s) in the refrigerator or freezer as soon as possible to ensure maximum freshness and product life. From the point of product arrival, you are solely responsible for the proper and safe washing, handling, preparation, storage, cooking, use and consumption of the Products following delivery. We recommend reviewing the United States Department of Agriculture’s (USDA) safe handling instructions included in your shipment to ensure that products are handled in a safe and appropriate manner. We also recommend following all cooking instructions and that you use a food thermometer to ensure that all meat items are cooked to the USDA’s recommended internal temperatures. Failure to follow these safe food handling practices and temperature recommendations may increase the risk of foodborne illness. In addition, pregnant women, young children, the elderly and individuals with compromised immune systems should follow the U.S. Food and Drug Administration’s recommendations on food consumption for at-risk groups.
In the event that your shipment arrives while you are not present, the package will be left at the door. We ensure that all products shipped from Authentic Wagyu contain gel packs and dry ice. These gel packs will keep the product cold once the dry ice is gone, for several hours. Depending on your geographical location and season of product delivery, the lifespan of these gel packs may vary. We recommend that you make plans in advance to receive your product in order to ensure maximum freshness and safe handling prior to consumption. In the event that you designate a person to receive your product delivery, the person at the delivery location who accepts the delivery is presumed to be authorized to receive it and is subject to the terms and conditions as outlined by Authentic Wagyu.
In the event of inclement weather that affects the shipment and delivery of your product beyond our control, we will attempt to deliver your order as soon as reasonably possible. If the specified delivery date may be compromised by inclement weather, we will attempt to ship the product prior to the scheduled delivery date. If in the event that these dates are not feasible, please contact info@authenticwagyu.com to adjust the date of delivery, or to inquire about order cancellation, credit issued, or a full or partial refund.
Website Access and Content Licensing
Any persons seeking to use the content of any kind, (as outlined below in this section) must receive prior approval from Authentic Wagyu by emailing info@authenticwagyu.com. These items are the property of Authentic Wagyu and any persons in violation of this property without express written consent is subject to the United States and international copyright laws.
Authentic Wagyu grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, and purchase items included in the content of this website. Any intent of the following is subject to legal matter:
(i) Unauthorized use of web text, information, pictures, videos, sound clips and verbal information, graphics, charts, data, the Authentic Wagyu name and logo, and all items directly associated with the Authentic Wagyu brand.
(ii) Any intent to distribute, alter/ modify, or interfere with Authentic Wagyu’s products, website, and related information, or data.
(iii) Redistributing, reselling, or publicly representing Authentic Wagyu and Authentic Wagyu products without written consent.
(iv) Data mining, the use of robotics or related methods to extract data and information, and use of data belonging to Authentic Wagyu and customer information.
(v) The interference with the security of Authenticwagyu.com or unauthorized access to its private information restricted to Authentic Wagyu use only. Furthermore, the interference of content, information, or features of this website or Authentic Wagyu.
(vi) The use of the content other than its intended purposes as determined by Authentic Wagyu.
Such violation of these measures and any act or attempt at interfering with the data or content belonging to Authentic Wagyu or its customers, or other unauthorized use of this information may be subject to applicable laws, including but not limited to copyright and trademark laws. In no way is this document providing legal permission for any person to use or distribute any information or products.
Authentic Wagyu reserves the rights to the information and content on this website not granted expressly in these terms.
Copyright Concerns
If you have any concerns about content generated and published by Authentic Wagyu, please contact us at info@authenticwagyu.com to report a claim. We will carefully review the claim and take action accordingly. We make every effort to avoid copyright of any kind.
If you choose to file a claim, it must include the following information in order to accurately assess the situation and to distribute the information to the necessary people.
(i) A signature (either electronic or physical) of the person authorizing this claim of copyright infringement.
(ii) A detailed description of the work that you claim infringes upon copyright or intellectual property.
(iii) A detailed description of your claim of the published work, where it is located.
(iv) Your contact information including first and last name, email address, physical address, and telephone number.
(v) A personal statement in good faith explaining that the work in question lies outside legal parameters and is not being used by the rightful owner, agent, or violates the law.
(vi) A statement made by you that the above information provided in your notice is accurate, and under penalty of perjury, you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
It is to be noted that any statement you make, knowingly making any kind of misrepresentation of the claim, you will be liable for any damages and expenses that result in this action, including but not limited to expenses and attorney fees, and the costs incurred that resulted from loss of working time and revenue and removal of information or material that is allegedly violating copyright laws.
